Client and complainant were in an argument
WP was a 22 year old who was in an intimate relationship with the complainant. The complainant alleged that at the time of the incident, the complainant was in the kitchen when WP started yelling at her. She further alleged that WP continued to shout abusive comments at the victim and at one point hit her with a tennis racquet. The incident caused her to run out of the unit upset and crying.
Charges against client withdrawn
The police arrested WP charging him with assault occasioning actual bodily harm.
The defence lawyers represented WP in his sentencing hearing where a pre-sentencing report was submitted to the court. The report outlined several factors related to offending including substance abuse and the recent breakdown of his long-term relationship. The successful defence representation by O’Brien Criminal & Civil Solicitors resulted in the assault charges being withdrawn.
Instead an apprehended violence order (AVO) was issued against WP that imposed conditions aimed at protecting the complainant.
