Police search found client with prohibited substances

Police were conducting patrols in the Toongabbie area when they found a parked car on the side of the road. Police pulled alongside the vehicle and found TM to be in the driver’s seat of the car. They claimed that he seemed nervous so they searched TM’s vehicle. They found a small quantity of three prohibited or restricted substances, and subsequently charged him with the possession of these substances.

Guilty plea

O’Brien Criminal and Civil Solicitors represented TM when he appeared in Parramatta Local Court. He pleaded guilty to all three charges. We assisted TM in preparation for his sentencing hearing including the production of character references and a letter from a psychologist regarding his mental health.

No conviction recorded

The Magistrate took into consideration the factors we presented including: TM’s background and personal circumstances, the fact that he had no prior criminal record, and was a person of prior good character. Also, he had good prospects of rehabilitation, was unlikely to re-offend and showed genuine remorse for what he had done. The Magistrate showed leniency and recorded a no conviction on the condition that he enter into a good behaviour bond (section 10).
