Client Sues Queensland Police for Assault, Battery & False Imprisonment – KW

Do you live in Queensland and thinking about suing Queensland police?

Read about how we recently assisted a client in their civil claim against the Queensland Police for assault, battery and false imprisonment.

A rude encounter with the police

KW was at a table in the outdoor seating area of a McDonalds Restaurant located at Surfers Paradise, on Queensland’s Gold Coast. One of his relatives stood between the roadside and the outdoor seating area where he was. He said to his relative words to the effect of “McDonald’s is this way”.

Shortly after, a police officer approached KW and asked him “Who said that?” KW responded with words to the effect of “It was me. Why?” The police officer started being rude and made statements to the effect of “Stop being a f***ing smart ass”. After several other statements, KW asked the police officer for his badge number. However, the officer refused to provide it and walked away.

Client assaulted and charged by the police

Later that night, KW walked to the edge of the footpath when again the same police officer approached him. After another conversation, the officer grabbed KW’s arm behind his back and twisted it. The officer forcefully pushed him to the ground and subsequently searched him.

He was taken to the police station and placed in custody where he remained for approximately 2 to 4 hours before being transferred to the Southport Holding Cells. KW was charged with public nuisance and assault officer in execution of duty which were subsequently withdrawn.
