Police v NK

Key Words: Common assault, Crimes Act 1900 section 61 – service station – non-conviction (dismissal of charges and conditional discharge of offender), Crimes (Sentencing Procedure) Act 1999 section 10

Facts:

The incident occurred at a service station. NK was in line to fill up his motorcycle. He was behind the victim’s car. The victim left his car at the bowser while he paid for his petrol. When he returned, NK asked him why he did not move his car before paying. NK then moved forward and struck the victim’s face with his helmet.

Outcome:
