Successful outcome for client who filed a civil claim for child physical and sexual abuse

John* filed a claim against the State of New South Wales. John sought compensation for child physical and sexual abuse he experienced from employees in two State-run institutions, when he was a child.

We represented John and claimed that:

  • The State breached their duty of care to John by failing to exercise a reasonable standard of care to protect him from child abuse.
  • The State is liable in negligence for failing to take reasonable care to prevent the personal injuries suffered by John.

John got an assessment by a psychiatrist who purported the abuse he suffered was the legal cause of the psychiatric injury.

This was an un-litigated claim. We met with representatives for the Defendant at an informal settlement conference, where John accepted an offer that was made to him.
