Graffiti charges dropped after being caught red handed

Robin was charged with a graffiti offence of ‘intentionally mark property without consent’ under section 4(1) of the Graffiti Control Act 2008 (NSW). He had two prior offences for graffiti.

Robin was charged by the police after being caught in the commission of the graffiti offence.

Robin pleaded guilty at the earliest opportunity.


Robin had not committed a relevant offence for 12 years and given the circumstances at the time of offending it was submitted that the Court finalise the matter under s10.

The charge was successfully dismissed without a conviction.
