GBB v State of NSW (NSW Police)

Facts:

GBB was walking at night in an inner City suburb with friends. It was alleged by police officers patrolling the area that he yelled abuse at a police officer. The police approached GBB and a confrontation ensued. The police placed GBB on the ground and one officer jumped on his knee, causing significant pain. GBB was arrested and then charged with using offensive language in a public place and assault/resist a police officer in the execution of duty.

Outcome:

O’Brien Criminal and Civil Solicitors acted for GBB in an action against the police for wrongful arrest, assault and malicious prosecution. The matter was settled after being filed in the District Court and GBB received significant compensation and damages for his treatment.
