DPP v BHG Bail Granted Strict Conditions

Key Words: Murder, Section 18 Crimes Act 1900 – self-defence, Section 418 Crimes Act 1900 – civilian arrest – bail granted

BHG was charged with murder, following an altercation with an armed intruder.

Bail was applied for in the Local Court, and granted on the basis that BHG had an arguable case at trial; that there were issues as to the cause of death; and that there were defences open to BHG. The delay in the matter coming to trial was also a relevant factor, as was BHG’s lack of criminal antecedents. Bail was granted on strict conditions.
