KV v Western NSW Local Health District & Ors – Client successfully reacquires Working with Children’s Check

Working with Children Check (WWCC) canceled

classroom school education childrenKV applied for his Working with Children Check (WWCC) in March, 2014. He was later verified, granted his WWCC and began employment as a Youth Support Worker.

A few years later, the Office of the Children’s Guardian received a workplace record of alleged sexual misconduct against KV. He subsequently received a notice of cancellation of his WWCC by the Office of the Children’s Guardian.

Police discontinued the investigation into KV’s alleged sexual misconduct due to there being no evidence to corroborate the claim. Furthermore, KV’s employer conducted their own internal investigation and did not sustain the allegations due to insufficient evidence.

Civil action against NSW Civil and Administrative Tribunal (NCAT)

O’Brien Criminal and Civil Solicitors subsequently commenced civil action against the NSW Civil and Administrative Tribunal (NCAT). Consequently we were able to successfully reacquire KV’s WWCC.
