Apprehended Domestic Violence Order applicant and defendant meet in public contravening ADVO
BW was subject to an ADVO from his wife. Whilst patrolling, police observed BW and the PINOP (Person In Need Of Protection) on bikes at George Street in Waterloo, talking to each other.
Police exited their vehicles and both BW and PINOP immediately faced the other way and attempted to avoid eye contact. Police approached the couple and asked for ID. Police issued BW and PINOP with a move on from the location and sighted leaving in different directions. Upon further checks later in the day, police found the current enforceable AVO between the two. Some days later, police attended BW’s home address and placed him under arrest for breach of AVO offence.
Section 10A order of conviction with no penalty for ADVO breach
O’Brien Criminal and Civil Solicitors successfully acted for BW at the Local Court. BW received a section 10A order of conviction with no penalty. The AVO conditions are to be enforced for 12 months.
