Facts – Breaking and Entering Police v DC
DC was charged with Break and Enter. He instructed his solicitor that he was innocent and that this was a case of mistaken identity. The matter was listed for a defended hearing.

The prosecution called a number of witnesses in a prosecution case. After hearing the evidence the court was not satisfied beyond reasonable doubt that DC was guilty and the charge was dismissed.
