DD v State of New South Wales – Successful claim for assault and battery

Victim falls from motorbike in police pursuit and is then assaulted

Suing the PoliceThe police in an unmarked police car were pursuing DD. The Plaintiff fell off his motorcycle, stood up and placed both his hands in the air surrendering to police.

In arresting DD, police tackled him to the ground, punched him in the upper and lower body, as well as kneeing him multiple times. This caused DD immediate pain.
