Client Sues Police after being Assaulted by Police – KM

O’Brien Criminal and Civil Solicitors are experts in assisting clients sue the police for false arrest, unlawful imprisonment and malicious prosecution. Read about one of our successful cases below.

Client manhandled by police officers

The client was going home when she stopped at a service station. Several police officers happened to be at the service station when she arrived. The client was acting in an ordinary manner when officers approached her. After some talking, they threw her to the ground, injuring her back and charged her with assault.

Charges against client withdrawn

Footage obtained from the service station showed that the client had done nothing wrong. Rather, the footage showed that she was the victim of police assault. The police withdrew the charges against her in the Local Court.

Successful civil claim against the police

KM approached O’Brien Criminal and Civil Solicitors to bring an action to sue the police for assault, battery, false imprisonment and malicious prosecution.  The police settled, and the client received compensation.
