Federal Member of Parliament is charged with disobeying police
BCD, a Federal Member of Parliament, was standing shoulder to shoulder with an assembly of protesters in front of a gate. Police deemed the protest unlawful as they had not received previous notice.
Police warned the protesters on three occasions that blocking or obstructing traffic is an offence and were directed to move. They refused. Police allege they had to use force to remove the protesters as they refused to move. Police charged BCD with not obeying direction of police and pedestrian obstructing drivers/other pedestrians’ path.

O’Brien Criminal and Civil successfully represented BCD, who pleaded guilty at Parramatta Local Court.
The magistrate dismissed the charges against BCD under section 10(1)(a) of the Crimes (Sentencing Procedure) Act 1999, and no conviction was imposed.
