A Victory for Justice: Misfeasance in Public Office
At O’Brien Criminal and Civil Solicitors, we are committed to protecting your rights and fighting for justice. In a recent case, we represent Jarred* who faced mistreatment while giving evidence in his own hearing.
The Incident: Mockery in the Courtroom
During Jarred’s hearing, an employee of the Commonwealth, who held a position of public office displayed disrespectful behaviour by mocking our client. Such behaviour undermined the integrity of the court proceedings and caused considerable emotional distress to Jarred.
Seeking Justice: Malicious Prosecution and Misfeasance in Public Office
Our firm filed proceedings for malicious prosecution and misfeasance in public office for this particular employee’s conduct while in duty of public office.
We filed legal proceedings on behalf of Jarred. We pursued two claims:
- Malicious prosecution; and
- Misfeasance in public office for this particular employee’s conduct while in the duty of public office.
The defendant brought a strike-out application which was successful with respect to the malicious prosecution claim. However, on appeal, we were able to reinstate the misfeasance in public office proceedings
A Favourable Resolution: Settlement and Compensation
The matter settled before the court hearing with our client receiving favourable monetary compensation.
