When Lucy’s kids became distressed, Lucy removed them from the house and took them for a drive. While she was stopped, police pulled her from the car, assaulted her, and handcuffed her. She was arrested and charged, but all charges were later dropped. We sued Queensland Police on her behalf. After initially denying fault, the State settled the case in our client’s favour.

What Happened?
Even though Lucy told the officers that she was heavily pregnant, she was still restrained for a long period of time, questioned, and accused of things she did not do. Officers finally released her without taking her to the station, but charged her for several offences.
Thankfully, all charges were dropped months later when prosecutors offered no evidence.

We sued the State of Queensland for:
- Assault and battery: for the physical force used during the arrest.
- False imprisonment: for unlawfully detaining Lucy without a valid reason.
The police acted with excessive force and failed to follow legal procedures, especially given Lucy’s vulnerable state as a pregnant woman.
The matter didn’t settle at mediation. The case progressed with amended court filings. Eventually, the State approached us with a settlement offer in favour of our client.
