What is the Definition of Murder in NSW?

Murder is defined under section 18(1)(a) of the Crimes Act 1900 (NSW) as an unlawful killing where the accused acted with reckless indifference to human life, with intent to kill, or with intent to inflict grievous bodily harm. A person may also be charged with murder if the death occurred during or immediately after the commission of a serious crime punishable by imprisonment of 25 years or more.

Under section 18(1)(b), every other punishable homicide is taken to be manslaughter. The distinction between murder and manslaughter often comes down to the mental element. Murder requires proof that the accused had a particular state of mind at the time of the act. If this mental element cannot be proven beyond reasonable doubt, the charge may be reduced to manslaughter.

Penalties for Murder in NSW

Murder carries the most severe penalty available under NSW law. Under section 19A of the Crimes Act 1900, a person convicted of murder is liable to imprisonment for life. There are prescribed standard non-parole periods for murder, including 20 years for general murder and 25 years where the victim is a child under 18 or falls within certain protected occupational categories such as police officers. The court can set a higher or lower period depending on the circumstances of the case.
