Common assault and robbery in company by children
ML was involved in an argument with a friend in Mosman shopping centre, on Sydney’s Lower North Shore, over ML’s girlfriend. The situation resulted in an altercation between ML and his friend with three other boys also present during the tussle.
ML was charged with three charges of Common Assault under section 61 of the Crimes Act 1900, and a charge of Robbery in Company under section 71(1).
Charges reduced to steal from person and ultimately dismissed at Children’s Court
O’Brien Criminal and Civil Solicitors negotiated a positive deal for ML at Children’s Court. Our criminal defence lawyers brought the Robbery in Company charge down to the lesser charge of ‘Steal from person.’
ML pleaded guilty to the offences and the charges were dismissed under section 33(1) of the Children (Criminal Proceedings) Act 1987 resulting in a caution to ML against further conduct.
