O’Brien Criminal & Civil Solicitors Commence Civil Proceedings Against NSW Police on Behalf of Hannah Thomas
O’Brien Criminal & Civil Solicitors has today filed civil proceedings in the Supreme Court of New South Wales on behalf of Hannah Thomas, arising from her arrest at the SEC Plating protests in Belmore earlier this year.
The proceedings have been commenced against the State of New South Wales, claiming damages for;
- malicious prosecution;
- assault and battery by police officers; and
- misfeasance in public office.
The civil claim follows a series of significant developments, including the withdrawal of all criminal charges against Ms Thomas and the subsequent criminal charge laid against a NSW Police officer involved in her arrest.
Statement from Principal Solicitor, Peter O’Brien
“This case represents a deeply troubling example of what happens when the rule of law is set aside by those sworn to uphold it. Our client was lawfully exercising her right to protest. What followed was an unlawful arrest and a sequence of actions that should never have occurred in a democracy governed by principles of justice and accountability.
This prosecution is a reminder that no one is above the law, and that accountability must extend to those in positions of power.
We are seeking redress not only for Ms Thomas’s individual suffering, including the ongoing injury to her right eye, but also to uphold the broader principle that police powers must never be abused. The law must protect citizens, not endanger them.”

– Peter O’Brien, Principal Solicitor.
Background of Hannah Thomas’ Case:
● Hannah Thomas, a Sydney resident, was arrested during a peaceful protest outside
SEC Plating in Belmore earlier this year.
● Following months of legal proceedings, all charges against Ms Thomas were dropped, confirming that the allegations were unfounded.
● In September, a NSW Police officer was charged with assault in connection with the arrest, a rare and significant step towards accountability.
● The civil action involves new and separate proceedings that seek damages and declarations from the Supreme Court concerning the conduct of police and the misuse of authority in this matter.
O’Brien Criminal & Civil Solicitors has a long and successful history of representing individuals who have been subjected to unlawful police conduct. This case continues the firm’s commitment to ensuring that those entrusted with power are held accountable under the same laws they enforce.
