Facts: Larceny and dishonestly obtaining property by deception
Police charged UJ, a teenage boy, with two offences:
- larceny pursuant to section 117, and
- dishonestly obtaining property by deception pursuant to section 192E(1)(a),
of the Crimes Act 1900.
UJ broke into a vehicle and stole a wallet containing a driver’s licence, a Medicare card and a bank card. After that, UJ attended a service station and purchased different food items and cigarettes with the bank card. Police obtained CCTV from the service station and subsequently arrested UJ.
Outcome: Penalties imposed by Children’s Court
O’Brien Criminal and Civil Solicitors successfully acted for UJ, who was found not guilty for larceny.
At the Children’s Court hearing, UJ was found guilty for the offence of obtaining by deception. However, UJ received no conviction and was released for 6 months pursuant to section 33(1)(e) of the Children (Criminal Proceedings) Act 1987.
