Successful Challenge Against Unlawful Detainee Risk Management Plans DRMPs

Police charged our client, Ben*, with possession of prohibited drugs. At the time of the incident, Ben admitted to having an addiction to cannabis. He then sought help from our drug lawyer.

Drug charges in NSW 

In 2022*, Ben was the passenger of a vehicle when the police pulled him and a friend over. Police noticed that Ben seemed nervous whilst speaking. Therefore, officers asked him to step out of the vehicle. He followed these instructions.

However, officers then noticed a bag at his feet. As a result, they searched it. They found a small quantity of illegal drugs. However, Ben claimed that he did now own the drugs. Yet, he admitted that he knew of their existence.

Police find more drugs

Later, the police found another small amount of drugs. It was cannabis. This time, Ben admitted that he owned the bag of substances. Additionally, he admitted he was addicted to cannabis.

As a result of the search, police arrested Ben. Police also charged Ben with suspected stolen goods in personal custody.

Drug lawyer advises pleading guilty to charges

On behalf of our client, our criminal drug lawyer entered a plea of guilty for the drug possession. However, our client alleged that he was not guilty of the stolen goods in custody offence. Therefore, we entered a plea of not guilty for Ben.

Our solicitors successfully applied for bail for Ben.

Finally, our criminal solicitors got the court to withdraw all charges. In the end, the judge marked the case dismissed.
