Redfern DUI charge
WS was charged with driving under the influence of an intoxicating substance (DUI) after he collided his motor vehicle into another vehicle in Redfern, in Sydney’s inner city.
Charge dismissed due to lateness
O’Brien Criminal and Civil Solicitors successfully acted for WS at the Downing Centre Local Court. There was only one charge listed for hearing, driving under the influence of a prohibited drug. Pursuant to the court rules they were required to file the charge within 6 months of the alleged offence. However, police had filed the charge a day after the 6-month time period.
The charge was marked as having “NO JURISDICTION”, meaning proceedings were dismissed by the court.
