Graffiti sprayer on ladderPolice charged Robin with a graffiti offence of ‘intentionally mark property without consent’ under section 4(1) of the Graffiti Control Act 2008 (NSW). He had two prior offences for graffiti charges.

Those charges by the police came after being caught in the commission of the graffiti offence.

Later, Robin pleaded guilty at the earliest opportunity.

Graffiti charges dismissed without conviction

However, Robin had not committed a relevant offence for 12 years. Given the circumstances at the time of offending we submitted to the magistrate that the Court finalise the matter under s10.

In conclusion, the charge was successfully dismissed without a conviction.
