Facts: Assault, battery and wrongful arrest by undercover police officer

DJA, the Plaintiff, worked at an inner city venue. While trying to eject a patron, DJA was grabbed, battered and arrested by an undercover police officer. The officer then informed DJA that he was under arrest. He asked why and the Officer responded “for resisting arrest”.

DJA was then pushed with substantial force into a street light and forcibly restrained on the ground. DJA’s arrest was witnessed by a large number of patrons and also his employer. This caused him to experience significant amount of embarrassment.

Outcome: Sue police for wrongful arrest amounting to false imprisonment, assault and battery
