Facts: charged with common assault and contravening AVO
MT became involved in a heated verbal argument with his girlfriend which lasted throughout the day. That night, MT assaulted her causing bruising to both legs, a scratch to her left shoulder and a swollen lower lip. The following day, the couple continued arguing and his girlfriend rang the police.
Upon arriving, MT offered to stay at a hotel for the night and left the premises. However, the girlfriend questioned why he was not arrested and later disclosed that she was assaulted. MT was charged with common assault and contravening AVO.
Outcome:
O’Brien Criminal and Civil Solicitors successfully represented MT at Parramatta Local Court. After successful negotiation, we accepted a deal from the Police Prosecutor. This resulted in the withdrawal of both charges, in exchange for consenting to final AVO orders being put in place for a period of 5 years.
