Service station common assault: Police v NK

Motorcyclist assaults driver with helmet at service station

The incident occurred at a service station.

NK was in line to fill up his motorcycle. He was behind the victim’s car. The victim left his car at the bowser while he paid for his petrol. Later, when he returned, NK asked him why he did not move his car before paying. NK then moved forward and struck the victim’s face with his helmet.

Police charged him with assault.

Section 10 for assault

Subsequently, O’Brien Solicitors helped achieve a section 10 non-conviction for NK.
