GA v State of NSW – Successful claim of trespass to property

Facts: Suspect’s home is robbed after police search leaves it open

A warrant was issued to search GA’s property after an application by police officers. Later that day, the officers executed the warrant at GA’s property.

Up to six officers entered GA’s property and used significant amount of force to unhinge the front door. During the search, several items from the home were seized.

The officers left GA’s property but did not secure the front door. GA’s home was subsequently robbed and had several personal possessions stolen. Later, the Supreme Court of NSW declared the search warrant invalid.

Outcome: Successful claim of trespass to property
