Representing Survivors Of Astill
In this case, the Plaintiff brought proceedings for damages arising from trespass to her person, including claims for aggravated and exemplary damages. Our client was an inmate at Dillwynia Correctional Centre when the abuse began. Mr Astill, a senior officer, exploited her vulnerability as a recovering addict by soliciting sexual favours in exchange for contraband substances.

Suing Corrective Services For Prison Officer Abuse
At the time of the incidents, the Plaintiff was 33 years old and actively engaged in drug rehabilitation programs while in custody. She was attempting to remain drug-free, making her particularly vulnerable to manipulation.
Mr Wayne Astill was a long-serving Corrective Services NSW officer who had been appointed to act in the rank of Chief Correctional Officer shortly before the abuse occurred. The Plaintiff alleged that on three separate occasions, Astill used his position of authority to solicit sexual favours from her in exchange for illegal substances. This conduct constituted a serious breach of trust and an abuse of power within a custodial environment.
Importantly, while Astill was later convicted by a jury of 27 criminal offences relating to the abuse of female inmates at Dillwynia Correctional Centre, the Plaintiff in this case was not one of the complainants in those criminal proceedings. As a result, a civil claim became her only avenue to seek recognition and compensation for the harm she suffered. She came to our firm for representation.

During the course of the proceedings, significant issues were raised regarding the imbalance of power between the parties and the Plaintiff’s vulnerability, including her efforts to rehabilitate and remain drug-free during her incarceration. The claim alleged conduct amounting to a clear trespass to her person, warranting compensatory damages as well as aggravated and exemplary damages to reflect the seriousness of the wrongdoing. The matter ultimately resolved on favourable terms for the Plaintiff.

The Plaintiff also received a formal apology from the Commissioner of Corrective Services NSW, Gary McCahon PSM, recognising the system’s failure to protect her.
