Wade* and his family were having dinner at a restaurant in Surfers Paradise, Queensland when things took a turn for the worse. The Police approached Wade and a minor disagreement ensued. When Wade asked for an officer’s badge number, he was verbally abused, searched, and physically assaulted. This happened in front of other diners and caused Wade embarrassment and distress.
Despite being innocent, Wade was arrested and spent several hours in custody before being charged with Public Nuisance and Assaulting a Police Officer. The next day, the charges were withdrawn and dismissed in court.
The laws covering QLD police powers to search are in the Police Powers and Responsibilities Act 2000 (QLD)
