Facts: Common Assault and Apprehended Domestic Violence Order (ADVO)
MG was in a domestic relationship with the victim for 5 years. MG had a verbal disagreement with the victim and subsequently used his closed fist to strike the victim on her shoulder. MG was charged with common assault (section 61 Crimes Act 1900). MG was also subject to an Apprehended Domestic Violence Order (ADVO).
Outcome: ADVO and assault charge withdrawn

Without the victim’s evidence, the prosecution was unable to proceed with the hearing and the charge of common assault was dismissed. An application to adjourn proudly was subjected to and defeated. The ADVO against MG was also withdrawn and dismissed.
