Over several weeks, Caraline’s mother alleged that she assaulted her on three occasions. The first accusation involved Caraline allegedly hitting her mother while she was driving. Following this incident, the police issued an Apprehended Domestic Violence Order (ADVO) against Caraline.
Subsequently, Caraline’s mother made further allegations, resulting in her being charged with assault occasioning actual bodily harm and breaching the ADVO. The final set of allegations resulted in Caraline facing the following charges:
- Three counts of common assault under s 61 of the Crimes Act 1900.
- One count of contravening a prohibition or restriction in an ADVO under s 14(1) of the Crimes (Domestic and Personal Violence) Act 2007.
- One count of assault occasioning actual bodily harm (domestic violence related) under s 59(1) of the Crimes Act 1900.
Defending against Assault charges Sydney
These charges could have resulted in up to two years of full-time imprisonment if proven in the Local Court of New South Wales. However, Caraline pled not guilty to all six charges and the court scheduled a hearing for all allegations.
