Suing for Administrative Court Error & Wrongful Arrest

Our client, Bill*, had no prior criminal record. Police wrongfully arrested him due to an administrative error. A simple scheduling mistake led to an unjust arrest warrant, a humiliating detention, and an invasive strip search. Here at O’Brien Criminal & Civil Solicitors we advocated for his rights and helped with suing for administrative court error and wrongful arrest.

Suing for administrative court error

In 2017, the Burwood Local Court mistakenly listed Bill’s court date. Unaware of this error, Bill arrived on the correct date. However, here he discovered they issued a warrant for his arrest due to his “failure to appear.”

Following his arrest and a distressing strip search, Bill sought justice for false imprisonment and other violations. Our lawyers at O’Brien Criminal & Civil Solicitors successfully negotiated on his behalf.

Suing for administrative court error

What happened?

They scheduled Bill to appear at Burwood Court. However, due to a handwritten error, court staff mistakenly recorded the hearing date on official documents. When Bill did not appear on the incorrect date, police issued a warrant for his arrest. As a result, this led to an avoidable but devastating chain of events.

When Bill attended court as originally scheduled, he learned of the error and was directed to the police station to clear up the matter. Instead of resolving the confusion, he was immediately arrested and subjected to a strip search.

Police detained him and transferred him to Corrective Services, where officers forcibly removed his bracelet—a cherished item inscribed with the names of his children. Bill endured an invasive search that breached his personal dignity and rights. This traumatic experience left Bill feeling shocked, humiliated, and distrustful of the judicial system.

Suing for administrative court error with our lawyers

Bill’s lawyers at O’Brien Criminal & Civil Solicitors filed a claim on his behalf, citing negligence, false imprisonment, and assault due to the administrative oversight.

In an Informal Settlement Conference, we secured compensation for Bill. This covered both emotional distress and violation of his rights. It included damages for the strip search and wrongful detention, as well as coverage of legal costs for his representation.
