Following a lecture event at the University of Sydney (USYD), Richard decided to partake in the post-lecture drinks. As events unfolded, he got kicked out and a security guard accused Richard of shoving him. Richard denied this.
The security guard then followed Richard to a bar nearby. The security guard made the decision to call the police. Responding to the call, two officers entered the bar, approaching Richard without providing clear reasons for their intrusion. Richard, frustrated by the lack of communication and their presence, called them “fascists”.
The officers failed to follow proper procedure:
- They did not issue a direction for Richard to leave or move on as per the Law Enforcement (Powers and Responsibilities) Act (LEPRA) or the Liquor Act provisions.
- They did not clarify the purpose behind their request for Richard’s identification.
- and they provided no clear explanation for their presence or intent.
Instead, the officers took it upon themselves to physically remove Richard from the bar, detaining him for nine hours. Subsequently, they charged him with assaulting the security guard and resisting arrest.
However, their actions constituted unlawful detention.
The Court Outcome:
Richard represented himself in Newtown Local Court, and Richard pleaded his case. The hearing resulted in the dismissal of both charges against him. Moreover, the presiding magistrate expressed critical remarks about the conduct of the involved police officers.
Continued Legal Proceedings for unlawful detention:
