Facts – Contravene AVO Police v RW

RW was charged with Assault Occasioning Actual Bodily Harm and contravening a condition of an Apprehended Violence Order. RW pleaded not guilty and the matter was listed for hearing.

Result 

Negotiations were entered into prior to the hearing. The prosecution accepted a plea of guilty to Contravene AVO and withdrew the charge of common assault. These negotiations were significant because had RW been found guilty of assault, he faced a sentence of full time imprisonment.

RW was sentenced to a section 9 bond to be of good behaviour for 12 months and avoided a sentence of imprisonment.
