Assault police officer in execution of duty – Section 60 Crimes Act 1900  – alcohol – aggressive behaviour – good behaviour bond – Section 9 Crimes (Sentencing Procedure) Act 1999 

Facts:

Our client was taken to the hospital by police in a state of moderate intoxication. While at the hospital, JZ had become agitated and aggressive, and had eventually tried to assault police by punching an officer in the face. He was quickly immobilised without causing any bodily harm.

Outcome:

Submissions were made against a custodial sentence, and instead our client received a section 9 good behaviour bond (twelve months). This result allowed JZ to stay with his partner, continue his job and focus on making positive changes with respect to his use of alcohol.
