Police v RW

Key Words: Contravening AVO – section 14 Crimes (Domestic and Personal Violence) Act 2007 assault occasioning actual bodily harm – section 59 Crimes Act 1900 – plea of not guilty

Facts:

RW was charged with Assault Occasioning Actual Bodily Harm and contravening a condition of an Apprehended Violence Order. RW pleaded not guilty and the matter was listed for hearing.

Result:

Negotiations were entered into on the morning of hearing. The prosecution accepted a plea of guilty to Contravene AVO and withdrew the charge of common assault. These negotiations were significant because had RW been found guilty of assault, he faced a sentence of full time imprisonment.

RW was sentenced to a section 9 bond to be of good behaviour for 12 months and avoided a sentence of imprisonment.
