Magistrate accepts defence’s submissions in sentencing hearing: Client JM

Defence assisted client in preparation for sentencing hearing

O’Brien Criminal & Civil Solicitors represented JM in his sentencing hearing at Newtown Local Court in relation to contravening his AVO on 6 occasions. The defence assisted JM in preparing a letter to the Court, tendering several character references and a letter from his psychiatrist.

Client avoids being sentenced to imprisonment

The Magistrate accepted the submissions in relation to the relatively low objective seriousness of the offences, JM’s remorse as shown by him pleading guilty at the earliest chance possible, and the fact that JM had already spent a period in custody. The Magistrate also considered the circumstances surrounding the incidents including JM’s mental illness and substance use issues. As a result, he was given several fines and good behaviour bonds and was able to avoid a term of imprisonment.
