Defence lawyers prepare for sentencing hearing

O’Brien Criminal & Civil Solicitors represented JM in his sentencing hearing at Newtown Local Court in relation to contravening his AVO on 6 occasions. The defence assisted JM in preparing for trial with a letter to the Court, tendering several character references and a letter from his psychiatrist.

Client avoids prison sentence

The Magistrate accepted the submissions in relation to:

  • the relatively low objective seriousness of the offences,
  • JM’s remorse as shown by him pleading guilty at the earliest chance possible,
  • and the fact that JM had already spent a period in custody.

The Magistrate also considered the circumstances surrounding the incidents including JM’s mental illness and substance use issues. As a result, he received several fines and good behaviour bonds and was able to avoid a term of imprisonment.
